General terms and conditions of sale

PREAMBLE
We invite you to read our General Terms and Conditions of Sale (“GTCS”) before using our website www.atelier-amaya.com (hereinafter the “Website”) and/or purchasing products of the brand L’Atelier d’Amaya (hereinafter the “Products”) on the Website and/or in any official L’ATELIER D’AMAYA store listed on the Website (hereinafter the “Store”).
ARTICLE 1: IDENTIFICATION OF THE SELLER
These General Terms and Conditions of Sale (GTCS) apply to sales made on the Website, as defined below, by the company L'ATELIER D'AMAYA E-COMMERCE, a simplified joint-stock company with a share capital of €12,911,190.00, whose registered office is located at 44–50 Boulevard George V, 33077 BORDEAUX Cedex (France), registered with the Bordeaux Trade and Companies Register under number 898 870 738 and under intra-Community VAT number FR04898870738 (hereinafter referred to as “L’Atelier d’Amaya”).
These GTCS also apply to sales made in Stores by the various companies belonging to the “L’ATELIER D’AMAYA” group. As not all Stores are operated by the same company within the group, it is the Client’s responsibility to refer to the list of the relevant companies provided in Appendix 2.
For any request for information, if the Customer does not find an answer in these GTCS or in the “FAQ: Questions & Answers” section, the Customer may contact L’Atelier d’Amaya’s customer service:

ARTICLE 2: SCOPE AND ACCEPTANCE OF THE GTCS
These GTCS define the rights and obligations of L’Atelier d’Amaya and of the buyer (hereinafter the “Customer”).
Any purchase of Products on the Website and/or in a Store necessarily implies the Customer’s full and unconditional acceptance of these GTCS.
Only final consumers—natural persons acting for non-commercial purposes—may be regarded as Customers, to the exclusion of any reseller or intermediary acting on behalf of a reseller. Accordingly, the Customer declares that they are acting as a final consumer and have no intention of reselling the Products, directly or indirectly, for commercial purposes.
The Customer certifies that they have the legal capacity to enter into the commitments set out herein.
L’Atelier d’Amaya may amend the GTCS at any time.
The Customer may consult the applicable version of the GTCS at any time in the “GTCS” section of the Website.
The GTCS in force at the time the order is placed on the Website or the purchase is made in a Store govern the contractual relationship between L’Atelier d’Amaya and the Customer.
For each purchase on the Website, the Customer will be asked to confirm acceptance of the GTCS in force. The applicable GTCS may be viewed before and at the time the Customer is requested to indicate acceptance by clicking “I have read the general terms and conditions of sale and accept them without reservation.”
Acceptance of the GTCS is formalised either by ticking the box associated with the statement “I have read the general terms and conditions of sale and accept them without reservation”, or by making any purchase in Store.
ARTICLE 3: FORMATION OF THE CONTRACT
The contract between L’Atelier d’Amaya and the Customer is formed upon effective payment of the order, materialised by the sending of an order confirmation email by L’Atelier d’Amaya for purchases made on the Website, or by the handover of the Products or a collection receipt for any purchase made in Store.
The order confirmation email summarises the details of the Customer’s order.
For purchases made in Store, the contract is formed upon effective payment, materialised by the issuance of the receipt.
Conversely, the contract is not formed if the Customer fails to pay for the Product(s), for any reason whatsoever.
ARTICLE 4: ONLINE ORDERING TERMS AND CONDITIONS
The Website enables Customers to place online orders for a selection of Products for delivery or in-Store collection, under the conditions set out in Article 11 “Delivery and In-Store Collection”.
The Customer may obtain assistance from L’Atelier d’Amaya’s customer service by telephone on +33 (0)5 56 81 57 71 (local call) to create their account and/or select one or more Products. However, the Customer remains solely responsible for placing the order.
4.1) Customer Account
To place an order on the Website, the Customer must either:
create a customer account by clicking “Create an account” and providing their title, surname, first name, date of birth, marketing and loyalty preferences, personal email address and a password; or
log in to their customer account using their personal email address and password.
Creating a customer account enables the Customer to:
enter personal information to facilitate future purchases;
consult, modify and update this information;
identify themselves before placing an order;
track current orders;
view order history and invoices;
return or exchange non-personalised Products;
manage their newsletter/SMS subscriptions with L’Atelier d’Amaya;
be automatically enrolled free of charge in L’Atelier d’Amaya’s loyalty programme and accumulate points on purchases;
view their loyalty points and valid loyalty vouchers.
The Customer is responsible for maintaining the confidentiality of their account credentials and for restricting access to their computer or other devices. The Customer undertakes not to disclose their login details to any third party and acknowledges that they are responsible for all activities carried out under their account.
If the Customer suspects unauthorised use of their account, they are advised to change their password and contact L’Atelier d’Amaya’s customer service to close the compromised account.
Unless proven otherwise by the Customer, the data recorded by the Website constitute proof of the nature, content and date of all transactions carried out between L’Atelier d’Amaya and the Customer.
In the event of a dispute regarding an order placed on the Website or by telephone, the data recorded by L’Atelier d’Amaya shall constitute valid proof of the transaction, unless the Customer provides evidence to the contrary.
The Customer may request the deactivation of their account at any time by contacting customer service.
4.2) Placing an Order on the Website
The Customer selects the Product(s) they wish to purchase and clicks “Add to basket”.
After each addition, a “Basket preview” window automatically appears, displaying the selected Product(s), unit price (incl. VAT), quantity and temporary subtotal.
If a Product is unavailable, it will be displayed as “unavailable” on its product page.
The Customer may subscribe to an email alert to be notified when the Product is back in stock, provided they have created a customer account.
At any time, the Customer may add Products to their basket or proceed to checkout.
The basket is accessible through the “Basket” menu, which displays all selected Products (description and photo), their unit price (incl. VAT), quantity and subtotal.
Before confirming the order, the Customer must carefully check the contents (Product(s), price, options). They will have the opportunity to verify these details again upon receipt of the confirmation email.
The Customer may access order details at any time via their personal account under “My orders”.
After selecting the Product(s), the Customer must:
click “Choose my delivery method” to begin checkout;
if not already logged in, enter their email address and password, or create an account under Article 4.1;
enter delivery details (country, title, surname, first name, postal address) and/or select the Store or collection point where the order will be collected (see Article 11);
select the delivery method;
click “Proceed to payment”;
choose the payment method: at this stage, the Customer may confirm the delivery address as the billing address or enter a different billing address;
read and accept the GTCS;
click “Payment” to proceed to secure payment;
complete payment in accordance with Article 9 “Payment”.
Once payment has been validated, the order is transmitted to L’Atelier d’Amaya for processing.
Once the order has been validated, L’Atelier d’Amaya sends an order confirmation email summarising the order (order reference, Product identification and essential characteristics, quantity, price excl. and incl. VAT, VAT amount and delivery fees). The email also confirms that the invoice is available in the Customer’s account.
Once the order has been prepared, the Customer receives an email informing them of dispatch and providing a tracking number, or confirming availability in Store for collection.
If the Customer does not receive any email (neither confirmation nor dispatch), they are advised to check their spam folder and contact customer service if necessary.
In accordance with Article L.213-1 of the French Consumer Code, for any order of EUR 120 or more, L’Atelier d’Amaya retains the electronic record of the contract for ten years from delivery. The Customer may access this document upon request and proof of identity.
4.3) Customer Cancellation Within 60 Minutes
For orders placed on the Website, the Customer has a right to cancel the order within sixty (60) minutes of confirmation.
This cancellation option applies to all Products, including personalised/engraved items, but does not apply to orders including a gift card.
It also does not apply if the Customer selected in-Store collection within 2 to 4 business hours (Article 11-3).
However, cancellation is possible if the Customer selected in-Store collection within 3 to 7 business days.
To cancel, the Customer must log into their account, go to “My account / My orders”, select the order and click “Cancel my order”.
After the sixty-minute period, no contractual right of cancellation applies.
The Customer may still exercise the statutory right of withdrawal within fourteen (14) days, as provided in Article 12.
4.4) Cancellation by L’Atelier d’Amaya
L’Atelier d’Amaya may cancel the Customer’s order for legitimate reasons, including but not limited to:
unavailability of the Product at the time of order, despite the Website indicating availability; in this case, L’Atelier d’Amaya shall inform the Customer and refund the relevant amount promptly;
fraudulent or abusive use of the customer account or orders;
breach of the GTCS.
ARTICLE 5: PRODUCTS
The essential characteristics of the Products are presented on the Website on each Product page, under the “Description” and “Characteristics” sections.
The images used are not contractual; slight differences may exist between the photographs and the actual Product. Photographs are the result of optical and technical processes and may therefore display variations or imperfections compared with the real appearance of the Products.
For size guidance, the Customer is advised to refer to the size guide available on the Product pages offering size options or to consult the “Size Guide” section available in the FAQ.
The Products remain the property of L’Atelier d’Amaya until full payment of the price has been received from the Customer.
All orders placed on the Website are dispatched subject to stock availability.
L’Atelier d’Amaya makes every effort to ensure that the Products are available when the order is placed. However, between the time of the Customer’s order and its confirmation, discrepancies may occur between the stock shown as available online and the actual physical stock.
Sales are therefore subject to the availability of Products in stock.
If one or more Products are unavailable, the Customer will automatically be refunded the price corresponding to the out-of-stock Product(s).
L’Atelier d’Amaya shall not be held liable in the event of stock shortages or Product unavailability.
L’Atelier d’Amaya reserves the right to modify, at any time and without notice, the Products offered on the Website.
ARTICLE 6: PROMOTIONAL OFFERS
In the event of promotional operations organised by L’Atelier d’Amaya, the duration of the operation will be indicated on the “Commercial Offers” page, through in-Store displays, and in newsletters.
ARTICLE 7: GIFT CARDS – CREDIT NOTES – LOYALTY VOUCHERS
7.1) Gift Cards
When purchasing a gift card:
- On the Website: the Customer receives an email at the address previously provided, containing the digital gift card code, which may subsequently be used by the recipient to make purchases on the Website.
When purchasing a gift card on the Website, the Customer acknowledges that the contract is executed immediately upon delivery of the digital gift card code by email. Accordingly, in accordance with Article L.221-28(13) of the French Consumer Code, the Customer expressly waives their right of withdrawal.
- In Store: the gift card code appears on the receipt issued at the time of purchase. This code may be used in Store and/or on the Website.
The Customer has no statutory right of withdrawal when purchasing a gift card in Store.
The Customer may not request from L’Atelier d’Amaya the return, exchange or refund—whether in cash or by credit note—of a gift card, regardless of the reason (including theft, loss or deterioration).
Products may be purchased using a gift card both on the Website and in Store.
Products purchased using a L’Atelier d’Amaya gift card are subject to the same terms and conditions as those purchased using any other payment method, as defined herein.
The conditions of use of the gift card may change over time; the applicable conditions are those in force at the time the order is placed.
7.2) Credit Notes
Credit notes issued by L’Atelier d’Amaya, regardless of their origin (Store or Website), may be used in all Stores and on the Website.
Credit notes are divisible and valid for six (6) months.
7.3) Loyalty Vouchers
In accordance with Article 23 “AMAYA & ME” LOYALTY PROGRAMME, the Customer may receive loyalty vouchers as a result of registering for the Programme.
After identifying themselves via their customer account on the Website or by presenting proof of identity in Store, each Member earns points when purchasing Products in Store and/or on the Website according to the following scale: EUR 1 spent = 1 point.
Points become available twenty-four to forty-eight (24 to 48) hours after the purchase.
Each point is valid for twelve (12) months from the date of issue and cannot be carried over.
Points may under no circumstances give rise to cash payment. They have no monetary value and are non-transferable.
For every two hundred (200) valid points accumulated on the loyalty account, a Loyalty Voucher with a face value of fifteen (15) euros is automatically credited to the Customer’s loyalty account.
The Customer will be notified by email when the Loyalty Voucher is issued.
The Loyalty Voucher is available and usable from the date of issue for a period of six (6) months and must be used before the end of that period.
The Loyalty Voucher cannot be converted into cash, a credit note, or a gift card, and cannot be used to purchase a Product whose price is lower than the face value of the Voucher.
The Loyalty Voucher is indivisible; it may not be used for several separate orders or transactions.
The use of a Loyalty Voucher on the Website requires that the Customer be logged into their customer account and place a new Product order, or, in Store, make a new purchase.
The Customer may use up to five (5) Loyalty Vouchers in a single purchase, whether online or in Store, even if they have different expiry dates, provided all vouchers are valid on the day of purchase.
ARTICLE 8: PRICES
The prices displayed in Store and on the Website are expressed in euros, inclusive of all taxes (VAT included), but exclusive of delivery charges.
Product prices may vary during the year; however, the Products ordered are invoiced at the price in force at the time the order is recorded.
The total amount payable by the Customer is the amount indicated once the Customer has selected the delivery method.
Upon receipt of the order confirmation, an invoice will be available in the Customer’s “My account” area. It includes a summary of the Products purchased as well as the total amount paid and debited.
ARTICLE 9: PAYMENT
Any Product purchased on the Website may be paid for using the following methods:
Bank card (Visa®, Mastercard®, Carte Bleue®)
Apple Pay
Google Pay
PayPal
Scalapay
Credit notes
Gift cards
Loyalty vouchers
Card payments are authenticated and secured through the 3D Secure system.
In accordance with the European PSD2 regulation, card payments are processed through highly secure pages dedicated to the entry of sensitive data (card number, expiry date and CVV code in compliance with PCI DSS standards). The payment platform encrypts and transmits the payment data confidentially to the Customer’s bank, rendering them inaccessible to third parties.
At no point do the Customer’s bank details pass through L’Atelier d’Amaya’s IT system.
For card payments, the debit is made at the time the order is validated, subject to approval by the issuing bank.
If the bank refuses the transaction, the order will not be validated.
Online card payment transactions are fully secured: the Customer’s payment details are encrypted (SSL protocol) and transmitted directly to a payment service provider, which queries banking servers to prevent fraud and authorises the payment.
At no time does L’Atelier d’Amaya have access to the complete card number entered by the Customer.
The Customer may pay using a gift card or a credit note, and may do so multiple times until the available balance has been fully used.
If the total amount of an order exceeds the remaining balance of the gift card, the Customer may pay the difference using any other accepted payment method.
Gift cards are valid for one year on the Website or in Store.
To use a gift card on the Website, the Customer must enter the code in the dedicated “Apply your credit note or gift card here” section at the basket stage. Once the code is applied, the corresponding amount is automatically deducted from the basket total.
If the code does not work or the discount is not applied, the Customer is invited to contact customer service.
In Store, the authorised payment methods are:
Bank card (Visa®, Mastercard®, Carte Bleue®)
Cash
Credit notes
Gift cards
Loyalty vouchers
American Express (only in certain Stores, where displayed)
ARTICLE 10: SHIPPING
L’Atelier d’Amaya makes every effort to prepare orders as quickly as possible. Preparation times may, however, be extended during peak periods or in the event of a pandemic.
When the order is dispatched, L’Atelier d’Amaya sends the Customer an email containing the tracking number, thereby enabling the Customer to locate the parcel and follow its progress on the carrier’s website.
L’Atelier d’Amaya cannot be held liable for any damage occurring during transport by the carrier or for delays or incidents arising from external causes (including, but not limited to: Customer error/fault, force majeure, shortages, postal and/or delivery service strikes, natural disasters, pandemics, wars, etc.).
ARTICLE 11: DELIVERY AND IN-STORE COLLECTION
11.1) Delivery Times
When placing an order, L’Atelier d’Amaya informs the Customer of the standard delivery time usually applied by the carrier. This delivery time is reiterated in the order dispatch confirmation email.
The delivery time indicated below runs from the date of the dispatch email; this period may be extended without L’Atelier d’Amaya incurring any liability.
Any order placed on a non-business day will result in the delivery time starting on the next business day.
Indicative delivery times are available on the “Deliveries” page of the Website.
11.2) Delivery to a Postal Address
L’Atelier d’Amaya delivers the Product(s) ordered to the delivery address indicated by the Customer at the “Delivery Address” stage of the order. The Customer must verify the accuracy of this address beforehand. Any re-shipment due to an incorrect address will be at the Customer’s expense.
Delivery charges are calculated based on the delivery method selected by the Customer at the “Delivery Method” stage.
All Products listed on the Website are available for delivery—subject to stock availability—to the countries indicated on the “Deliveries” page.
It is not possible to place an order for delivery to an address located outside the countries listed on the “Deliveries” page.
11.3) Collection in an L’Atelier d’Amaya Store
The Customer may choose in-store collection as the delivery method at the “Delivery Method” stage of the order.
This service is free of charge.
The timeframe for collection is indicated for each Store at the “Delivery Method” stage:
If the Product(s) included in the order are in stock at the selected Store, the Customer may collect the order within two (2) to four (4) business hours following the order confirmation. This option is not available for engraved or personalised Products.
If the Product(s) included in the order are not in stock at the selected Store, the Customer may collect the order within three (3) to seven (7) business days from the order confirmation.
The Customer is notified by email when the order is available for collection in Store.
The Customer may collect the order during the Store’s opening hours within a maximum period of ten (10) days from its availability.
To collect the order, the Customer must present a valid form of identification and the order confirmation email.
Any order not collected by the Customer within ten (10) days from the date of availability will be refunded from the thirty-first (31st) calendar day following the order confirmation, after L’Atelier d’Amaya has confirmed that the Customer failed to collect the order within the contractual timeframe.
Engraved Products that are not collected will not be refunded under any circumstances.
ARTICLE 12: STATUTORY RIGHT OF WITHDRAWAL FOR DISTANCE SALES
In accordance with Articles L.221-18 and L.221-20 of the French Consumer Code, the Customer has a statutory right of withdrawal, applicable only to distance contracts (i.e. orders placed on the Website).
The Customer has fourteen (14) days from the day following receipt of the Product(s) to exercise this right, without having to provide any justification.
The Customer must notify L’Atelier d’Amaya of their intention to exercise the right of withdrawal within the above-mentioned period by logging into their customer account, selecting the order concerned and clicking the “Refund” option.
Once this period has expired, the Customer may no longer invoke the right of withdrawal.
In accordance with Article L.221-24 of the French Consumer Code, in the event of a refund request, the Customer will be reimbursed for the price of the returned Product(s), as well as the standard delivery costs (Colissimo Home Delivery – without signature), no later than fourteen (14) days after L’Atelier d’Amaya receives the Customer’s withdrawal request or until the returned Product(s) have been effectively received by L’Atelier d'Amaya.
L’Atelier d’Amaya is under no obligation to reimburse additional delivery costs resulting from the Customer’s choice of a more expensive delivery method.
Return shipping costs incurred by the Customer when returning Product(s) in connection with the exercise of the right of withdrawal remain at the Customer’s expense.
The Customer does not benefit from the right of withdrawal if the Product(s) have been damaged due to improper handling or misconduct by the Customer.
L’Atelier d’Amaya will refund the Customer using the same payment method as that used to pay for the order; the refund will be issued in the same currency as that used at the time of purchase, within fourteen (14) days following the Customer’s notification of withdrawal.
For refunds of payments made using a gift card, credit note or loyalty voucher, the corresponding amount will be re-credited to the relevant gift card, credit note or loyalty voucher. L’Atelier d’Amaya will not issue any cash refund in such cases.
Limitations to the Right of Withdrawal
Pursuant to Article L.221-28(3) of the French Consumer Code, the Customer does not benefit from the right of withdrawal for customised Products (engraving, personalisation, special requests, etc.).
Similarly, pursuant to Article L.221-28(13), the Customer does not benefit from the right of withdrawal for gift cards purchased on the Website, as they constitute “digital content supplied without a physical medium, the performance of which has begun before the end of the withdrawal period”, for which the Customer must:
i) provide express prior consent for the contract to be performed before the end of the withdrawal period, and
ii) acknowledge loss of the right of withdrawal.
The Customer is encouraged to submit the withdrawal request online by logging into their customer account, under “My Orders” → “Return a Product”, and entering the reason for reimbursement. Return requests will appear under the “My Returns” section.
The Customer may also exercise the right of withdrawal by contacting customer service or by using the withdrawal form available in Annex 1 of these GTCS.
The right of withdrawal applies exclusively to orders placed on the Website and does not apply to any in-Store purchases.
ARTICLE 13: RETURNS POLICY AND COMMERCIAL CREDIT NOTES
In addition to the statutory right of withdrawal applicable to distance sales, as outlined in Article 12 “STATUTORY RIGHT OF WITHDRAWAL FOR DISTANCE SALES”, which entitles the Customer to a refund, the Customer has a period of thirty (30) days from receipt of the order to submit a request for a return and the issuance of a credit note.
After this period, no request will be accepted. Personalised Products (engraved or made to order) cannot be returned, except where the Customer exercises statutory rights relating to lack of conformity or hidden defects.
For online purchases, the Customer must submit the return request directly through their customer account by selecting the relevant order and choosing the “Exchange” option.
The request is then subject to validation by L’Atelier d’Amaya.
If the request is refused, an email will inform the Customer, along with the possibility of contacting customer service.
If the request is accepted, a confirmation email and detailed instructions for returning the Product(s) will be sent to the Customer, with the option to contact customer service if necessary.
In any event, the Customer will only be issued a credit note once the returned Product(s) have been physically received into L’Atelier d’Amaya’s stock.
Return requests for purchases made in Store may be submitted directly in Store and must be made within thirty (30) days from the purchase date, upon presentation of proof of purchase for the Product(s) concerned.
The Customer may use the credit note to make one or several purchases within six (6) months from the date of issue.
The Customer who has purchased Products on the Website retains the statutory right of withdrawal in accordance with Article 12 “STATUTORY RIGHT OF WITHDRAWAL FOR DISTANCE SALES”.
This Article does not apply to Products that have been altered as part of a special order (engraving, personalisation, etc.) or to gift cards.
ARTICLE 14: ONLINE RETURNS
The Customer must submit a return request in accordance with Articles 12 and 13 above.
Once the return request has been submitted, L’Atelier d’Amaya invites the Customer to return the Product(s) to the following address:
L’Atelier d’Amaya – 44–50 boulevard George V, 33077 Bordeaux Cedex (France).
L’Atelier d’Amaya recommends returning Product(s) using tracked postage. The Customer may choose the carrier of their choice, provided they are able to supply L’Atelier d’Amaya, upon request, with a tracking number and proof of shipment.
The return shipping costs are the Customer’s responsibility, except where the return is made under the statutory warranties of conformity and/or hidden defects.
If the Customer wishes to return several Products from the same order, it is essential that all Products be returned together.
Any returned Product must be intact, unworn, and in its original packaging.
If the Product is damaged during transit, the Customer will bear any losses occurring before the parcel is handed over to the carrier. If the Customer uses a carrier other than the one recommended by L’Atelier d’Amaya, the Customer will also bear any transport-related damage. In such cases, the return will not be accepted, and the Product will be sent back to the Customer at their own expense, with no refund, exchange or credit note issued.
In the event of a full refund request, the Customer must return the entire order, including, without limitation, the Product(s), packaging, and any promotional items or gifts (e.g. tote bags, cotton pouches).
If the return is incomplete, L’Atelier d’Amaya will be unable to process the refund.
L’Atelier d’Amaya will neither refund nor exchange Products that have been engraved or personalised, nor gift cards, in accordance with Article L.221-24 of the French Consumer Code.
Products purchased on the Website—except those bought during limited-time promotional operations (“Archives”)—may be returned in Store. The refund may take up to fourteen (14) business days from the date of drop-off.
Products purchased during “Archives” promotional operations cannot be returned in Store.
If the return results from an error by L’Atelier d’Amaya (e.g. incorrect item, incorrect size, hidden defect), L’Atelier d’Amaya will refund the standard delivery costs and dispatch a replacement Product at its own expense. The Customer may also request a full refund of the Product and related delivery costs.
ARTICLE 15: COMMERCIAL WARRANTY
Warranty duration: L’Atelier d’Amaya offers a commercial warranty of one (1) year from receipt of the order for all Products, except coloured tassels, cords and Liberty fabrics, which are covered for three (3) months.
This warranty applies only in the context of normal use of the Product and upon presentation of proof of purchase (receipt, order reference, customer account).
Conditions of application of the warranty
The warranty applies under normal conditions of use and does not cover defects resulting from accidents, improper handling or misuse (including but not limited to: impacts, dents, crushing, exposure to corrosive substances), theft, loss, or normal wear and ageing of the Product.
However, any defective component due to a manufacturing fault duly established by L’Atelier d’Amaya’s customer service will be repaired or replaced.
If the Customer encounters a problem during the warranty period, they may go to a Store, contact customer service at contact@latelierdamaya.com, or call +33 (0)5 56 81 57 71, or log into their customer account and submit a return request selecting the reason “Jewellery care”.
When returning Product(s), they must be protected and carefully placed in their original packaging and sent to:
L’Atelier d’Amaya, 44–50 Boulevard George V, 33077 Bordeaux Cedex, along with the invoice.
Returned Product(s) must also be accompanied by the return authorisation email issued by L’Atelier d’Amaya.
As part of this one (1) year commercial warranty, the Customer may return jewellery for after-sales service either by bringing it to a Boutique or by sending it to the customer service department. Where the Customer chooses to send the item to customer service, shipping costs will be covered by L’Atelier d’Amaya for any request made within six (6) months of the purchase date shown on the invoice. Beyond this period, and until the expiry of the commercial warranty (i.e. until the twelfth (12th) month following the purchase date), shipping costs shall remain the responsibility of the Customer.
This commercial warranty is without prejudice to the statutory warranties set out below.
ARTICLE 16: STATUTORY WARRANTIES
The Products sold by L’Atelier d’Amaya are subject to the statutory warranty provisions set out in Articles L.217-3 to L.217-17 of the French Consumer Code and Articles 1641 to 1648 of the French Civil Code, to the exclusion of all other warranties.
These statutory warranties apply independently of the commercial warranty described above.
• Statutory Warranty of Conformity (Articles L.217-3 to L.217-17 of the French Consumer Code)
L’Atelier d’Amaya undertakes to deliver a Product that conforms to the contract and is free from any lack of conformity at the time of delivery. This means that the Product must be suitable for the use ordinarily expected of a similar item and possess the characteristics agreed upon at the time of sale.
L’Atelier d’Amaya is also liable for defects arising from packaging or installation instructions, and from installation itself when it has been carried out under its responsibility or at its expense.
This warranty applies only if the Customer submits a claim within two years from delivery of the Product.
Defects of conformity that appear within twenty-four (24) months of delivery are presumed to have existed at the time of delivery, unless proven otherwise.
The Customer may choose between repair and replacement of the Product, unless one of these options is impossible or results in a manifestly disproportionate cost for L’Atelier d’Amaya, in which case the alternative remedy may be offered.
In the event of a serious defect of conformity, the Customer may return the Product and obtain reimbursement of the price, or keep the Product and obtain a partial refund in the form of a purchase voucher, which the Customer expressly accepts.
Repair, replacement or reimbursement will be made at no cost to the Customer and does not prevent the award of damages if the Customer is entitled to them.
• Statutory Warranty Against Hidden Defects (Articles 1641 to 1648 of the French Civil Code)
L’Atelier d’Amaya undertakes to deliver a Product free from hidden defects which render it unfit for its intended use or which diminish its usefulness to such an extent that the Customer would not have acquired it, or would have paid a lower price, had they known of the defect.
This warranty applies only if the Customer submits a claim within two (2) years of discovering the defect.
In the event of a hidden defect, the Customer may return the Product and obtain reimbursement of the price and any expenses arising from the sale, or keep the Product and obtain a partial refund in the form of a purchase voucher, which the Customer expressly accepts.
In all cases, the Customer must prove that the conditions of the statutory hidden defects warranty are met.
In the event of lack of conformity or hidden defects, the Customer must contact customer service and return the Product(s).
ARTICLE 17: AFTER-SALES SERVICE
Outside the statutory and/or commercial warranties described above, any Product that is technically repairable is eligible for paid after-sales service.
For any repair request, the Client must contact L’Atelier d’Amaya to request a repair, either by visiting a Store, or via the Website through their customer account by clicking on the “My Orders” tab / “Return an item” / “Jewelry Care”, or by email or telephone.
L’Atelier d’Amaya will then carry out an assessment and provide the Customer with a quotation.
If the Customer accepts the quotation, they must pay the corresponding amount. Once payment has been made, L’Atelier d’Amaya will proceed with the repair and return the repaired Product to the Customer.
ARTICLE 18: LIABILITY
L’Atelier d’Amaya shall not be held liable for any damage that does not result from a failure by L’Atelier d’Amaya to fulfil one of its obligations.
L’Atelier d’Amaya is not responsible for the use of any external websites that the Customer may access through links available on the Website.
ARTICLE 19: SEVERABILITY
If any clause or paragraph of these GTCS is found to contravene the law and is deemed null and void or unenforceable, such a finding shall not affect the validity of the GTCS as a whole.
ARTICLE 20: CONTRACT LANGUAGE – APPLICABLE LAW – DISPUTES – CONSUMER MEDIATION
The language of these GTCS is French.
These GTCS are governed by French law.
In the event of a dispute, the parties shall seek an amicable solution before initiating any legal action.
In accordance with Ordinance No. 2015-1033 of 20 August 2015 and Decree No. 2015-1382 of 30 October 2015, any consumer dispute or claim—subject to Article L.612-2 of the French Consumer Code—may be settled amicably through mediation by the CM2C – Centre de Médiation de la Consommation de Conciliateurs de Justice.
To submit a dispute to the mediator, the Customer may:
i) complete a claim form on the CM2C website under “I am a consumer – I wish to declare a dispute and obtain mediation”;
ii) send their request by post to CM2C, 49 rue de Ponthieu, 75008 Paris; or
iii) send an email using the contact form available under the “Contact” section of the CM2C website.
Regardless of the submission method, the Customer must provide: personal details (surname, first name, postal address, postcode, city, telephone number, email),
the SIRET number of L’Atelier d’Amaya,
the purchase date,
a description of the Product purchased,
the date and reason for the initial complaint to L’Atelier d’Amaya,
the current status of the dispute,
and evidence of prior attempts to resolve the issue with L’Atelier d’Amaya.
For contracts concluded online, the Customer may also use the European online dispute resolution platform:
https://ec.europa.eu/consumers/odr
In accordance with Article L.223-1 of the French Consumer Code, the Customer may register free of charge on the “Bloctel” telephone marketing opt-out list (www.bloctel.gouv.fr) to no longer be contacted for telemarketing purposes by professionals, except where calls relate to the performance of an existing contract.
Failing amicable resolution, any disputes arising from these GTCS (including, without limitation, their validity, interpretation, performance, termination, consequences or aftermath) shall be submitted to the competent court in accordance with applicable jurisdiction rules.
ARTICLE 21: INTELLECTUAL PROPERTY
L’Atelier d’Amaya is the owner of the Website.
Accordingly, the Website and all elements composing it (including, without limitation, texts, structures, software, animations, trademarks, designs, models, logos, graphics, photographs, diagrams, etc.) constitute intellectual works protected under the laws governing literary and artistic property rights and similar rights. These elements are the exclusive property of L’Atelier d’Amaya or its suppliers.
Any use of all or part of the Website—particularly downloading, reproduction, transmission, representation or distribution—for purposes other than strictly personal, private and non-commercial use is strictly prohibited.
All elements, trademarks, designs, models, logos, graphics, photographs, diagrams, etc. appearing on the Products or their packaging, and more generally all intellectual property rights relating to the Products, remain the exclusive property of L’Atelier d’Amaya.
Any infringement of L’Atelier d’Amaya’s rights exposes its author to the sanctions provided by both the French Intellectual Property Code (including, without limitation, copyright and trademark infringement) and the French Civil Code (civil liability).
ARTICLE 22: PROCESSING OF PERSONAL DATA
22.1) Definitions
For the purposes of these GTCS, the following terms have the meaning given to them in Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and French Law No. 78-17 of 6 January 1978 as amended (“Loi Informatique et Libertés”):
Personal Data: any information relating to an identified or identifiable natural person, directly or indirectly, in particular by reference to a name, an identification number, location data, an online identifier, or to one or more specific elements of their identity.
Data Subject: any natural person whose Personal Data is collected and processed by L’Atelier d’Amaya under these GTCS.
Data Controller: L’Atelier d’Amaya, which determines, alone or jointly with others, the purposes and means of processing Personal Data.
Processing: any operation or set of operations performed on Personal Data (collection, recording, storage, modification, extraction, consultation, use, transmission, deletion, etc.), whether automated or not.
22.2) Data Controller
The Data Controller is L’Atelier d’Amaya, a SAS registered with the Bordeaux Trade and Companies Register under number 898 870 738, whose registered office is located at 44–50 George V, 33077 Bordeaux Cedex.

22.3) Data Collected and Purposes
The Personal Data collected in the context of the contractual relationship are used for the following purposes:
order, payment and billing management;
delivery of Products;
customer relationship management (after-sales service, information requests);
compliance with L’Atelier d’Amaya’s legal and tax obligations;
management of customer accounts on the Website;
where applicable, the sending of commercial offers if you have consented or if you are an existing customer.
The data collected may include: title, surname, first name, postal address, email address, telephone number, login data and payment data.
No automated decision-making or profiling is carried out.
22.4) Legal Basis
These Personal Data Processings are based, as applicable:
on performance of the contract (ordering, delivery, billing);
on compliance with legal obligations (including accounting and tax requirements);
on consent, for commercial communications or the use of non-essential cookies; or
on L’Atelier d’Amaya’s legitimate interest in ensuring Website security and preventing fraud.
22.5) Recipients and Transfers
Personal Data are processed exclusively by authorised L’Atelier d’Amaya personnel and may be transmitted, strictly as necessary, to technical service providers acting as data processors (delivery, payment processing, technical maintenance, etc.).
These processors are bound by contractual obligations requiring compliance with GDPR rules, including confidentiality, security and lawful processing.
Personal Data are not sold or transferred to unauthorised third parties, nor transferred outside the European Economic Area.
22.6) Data Retention
Personal Data are retained:
for the duration of the contractual relationship;
then archived for five (5) years from the end of the contractual relationship for evidentiary purposes and to fulfil legal obligations.
Payment data are not retained beyond the transaction except with express consent.
Personal Data used for marketing purposes are retained for three (3) years from the last active contact.
22.7) Rights of Data Subjects
In accordance with applicable regulations, every Data Subject has the following rights:
Where Processing is based on consent: the right of access, rectification, erasure, restriction of Processing, portability, and the right to withdraw consent at any time without justification.
Where Processing is necessary for contract performance: the right of access, rectification, erasure, restriction and portability.
Where Processing is based on legitimate interest: the rights of access, rectification, erasure, restriction and objection.
Where Processing is necessary to comply with a legal obligation: the rights of access, rectification and restriction.
Data Subjects also have the right to define instructions regarding the fate of their Personal Data after death.

ARTICLE 23: CUSTOMS
Any order placed on the Website and delivered outside mainland France may be subject to customs duties and potential taxes imposed upon arrival of the order at its destination.
Such customs duties and taxes relating to the delivery of one or more Product(s) are the responsibility of the Customer and shall be borne exclusively by them.
L’Atelier d’Amaya is not required to verify or inform the Customer of applicable customs duties and taxes. It is the Customer’s responsibility to obtain this information from the competent authorities of the destination country.
ARTICLE 24: “AMAYA & ME” LOYALTY PROGRAMME
The “Amaya & Me” loyalty programme (hereinafter the “Programme”) is developed by L’Atelier d’Amaya.
This Article sets out the content and operating procedures of the Programme applicable between L’Atelier d’Amaya and Customers who meet the eligibility requirements for enrolment (hereinafter the “Members”).
The Programme enables Members, under the conditions outlined below, to accumulate points when purchasing Products in Store or on the Website, and to benefit from loyalty rewards in the form of purchase vouchers.
24-1) Scope
The Programme is valid in all L’Atelier d’Amaya Stores and on the Website.
The Programme does not apply to:
expenses related to “Services” (shipping fees, cord changes, after-sales service fees, complimentary piercing offered with the purchase of a prosthesis worth more than forty-nine (49) euros, etc.);
orders placed using a gift card;
orders placed using loyalty vouchers as defined below;
orders placed by L’Atelier d’Amaya employees;
orders paid using a credit note.
24-2) Conditions of Enrolment in the Programme
Enrolment in the Programme is automatic and free of charge, provided the Member creates a customer account on the Website or voluntarily provides their email address in Store. Enrolment is personal and reserved for natural persons for their own personal use.
Enrolment in the Programme does not constitute prior acceptance to receive L’Atelier d’Amaya commercial communications (Newsletter and/or SMS).
However, reminders relating to the existence or expiry of loyalty vouchers will not be sent if the Customer has not subscribed to the Newsletter.
Enrolment results in the assignment of a personal loyalty number.
Each Customer may only be enrolled in the Programme once.
24-3) Accumulation of Points
The Programme enables each Member, after identification through their customer account on the Website or by providing proof of identity in Store, to accumulate points when purchasing Products in Store and/or on the Website according to the following scale: EUR 1 spent = 1 point.
Points become available within twenty-four to forty-eight (24–48) hours after purchase.
Each point is valid for twelve (12) months from the date of issue and cannot be carried over.
Points can never be exchanged for cash, have no monetary value, and are non-transferable.
24-4) Award of the Loyalty Reward
For every two hundred (200) points accumulated on the Member’s loyalty account, a loyalty reward called a “Loyalty Voucher” worth fifteen (15) euros will automatically be credited to the Member’s account.
All points held by the Member are visible under the “Loyalty Programme” section.
If the Member has not received a Loyalty Voucher, they may contact L’Atelier d’Amaya’s customer service.
The Member will be notified by email on the date the Loyalty Voucher is issued.
The Loyalty Voucher is personal and non-transferable.
24-5) Use of the Loyalty Voucher
The Loyalty Voucher cannot be converted into cash, a credit note or a gift card, and cannot be used to purchase a Product whose price is lower than the face value of the Voucher.
The Loyalty Voucher is indivisible; it cannot be used for several orders or multiple separate purchases.
Use of a Loyalty Voucher requires the Member to be logged into their loyalty account.
The Member may use up to five (5) Loyalty Vouchers in a single purchase, whether in Store or on the Website, even if the vouchers have different expiry dates, provided they are all valid on the day of purchase.
Amounts paid using a Loyalty Voucher do not generate loyalty points, in accordance with Article 24-1 “Scope”.
The Loyalty Voucher is usable immediately upon issuance and is valid for six (6) months from the date it becomes available on the loyalty account. It must be used before the end of this period.
24-6) Cancellation of Points and Loyalty Vouchers
Points associated with an order that has been refunded or returned will be cancelled and deducted from the Member’s loyalty account.
If one or more Loyalty Vouchers were issued for such points, the Voucher(s) will also be cancelled.
24-7) Breach of Article 24 or Abusive Use of the Programme
Any breach of this Article and/or any abusive or fraudulent use of the Programme may result, at L’Atelier d’Amaya’s discretion, in the immediate suspension of the loyalty account, leading to the loss of all associated benefits. This may occur, for example, if L’Atelier d’Amaya determines that the same person holds multiple loyalty accounts or cards.
L’Atelier d’Amaya reserves the right to take any action it deems appropriate in the event of abusive or fraudulent use of the Programme.
ARTICLE 25: COMPETITIONS AND PARTNER COMPETITIONS
L’Atelier d’Amaya may organise competitions in which prizes are provided by its commercial partners.
In this context, L’Atelier d’Amaya cannot be held liable for any damage arising from errors in prize allocation, for damage caused by the prizes to property, or for any lack of quality or conformity of the prizes.
Images of the prizes displayed in connection with the competition are for illustration only; they are not contractual and may differ from the prize actually awarded.
Prizes cannot be exchanged or refunded for any reason once awarded.
Winners must collect their prize within one month from the official notification of their win, which may be communicated via social media tagging.
After this period, the prize will be considered forfeited and the winners will no longer be entitled to claim it.
ANNEX 1: WITHDRAWAL FORM
THE WITHDRAWAL REQUEST IS AVAILABLE IN THE CUSTOMER ACCOUNT. L’ATELIER D’AMAYA ENCOURAGES THE CUSTOMER TO USE THIS CHANNEL AS A PRIORITY.
