Any purchase of Products on the Website constitutes the Customer’s full and unconditional acceptance of these GTCS.

The Customer declares that they have the legal capacity to enter into the commitments set out in these GTCS.
L’Atelier d’Amaya may amend these GTCS at any time. The version applicable to the Customer is the version in force at the time the order is placed on the Website.
The current version of the GTCS may be consulted at any time in the dedicated section of the Website.
For each purchase made on the Website, the Customer will be asked to confirm their acceptance of the GTCS in force at the time of the order. The GTCS may be viewed before and at the time the Customer is asked to confirm their acceptance by ticking the relevant box.
Acceptance of the GTCS is formalised by ticking the box stating that the Customer has read and accepts the General Terms and Conditions of Sale without reservation.

Credit notes are divisible and valid for six (6) months from the date of issue.
7.3) Loyalty Vouchers
In accordance with Article 23 “AMAYA & ME” Loyalty Programme, Customers may receive Loyalty Vouchers as part of the Programme.
After identifying themselves through their customer account on the Website, Members earn points when purchasing eligible Products on the Website according to the following scale: EUR 1 spent = 1 point.
Points become available twenty-four to forty-eight (24 to 48) hours after the purchase.
Each point is valid for twelve (12) months from the date of issue and cannot be carried over.
Points have no monetary value, are non-transferable and cannot be exchanged for cash.
For every two hundred (200) valid points accumulated in the Customer’s loyalty account, a Loyalty Voucher with a face value of fifteen (15) euros is automatically credited to the Customer’s account.
The Customer will be notified by email when the Loyalty Voucher is issued.
The Loyalty Voucher is available and usable from the date of issue for a period of six (6) months and must be used before the end of that period.
The Loyalty Voucher cannot be converted into cash, a credit note or a gift card, and cannot be used for an order whose total value is lower than the face value of the Voucher.
The Loyalty Voucher is indivisible and cannot be used across several separate orders or transactions.

ARTICLE 10: SHIPPING
L’Atelier d’Amaya makes every effort to prepare and dispatch orders as quickly as possible. Preparation times may be extended during periods of high demand or in exceptional circumstances.
Once the order has been dispatched, L’Atelier d’Amaya sends the Customer an email containing the relevant tracking information, where available, enabling the Customer to track the progress of their parcel through the carrier’s website.
L’Atelier d’Amaya is not responsible for delays or incidents caused by circumstances beyond its reasonable control, including, but not limited to, events affecting the Customer, carrier disruptions, strikes, natural disasters, pandemics, wars or other events of force majeure.
This does not affect the Customer’s statutory rights under applicable law.
ARTICLE 11: DELIVERY
11.1) Delivery Times
When placing an order, the Customer will be informed of the estimated delivery time applicable to the selected delivery method. The estimated delivery time will also be indicated in the order confirmation or dispatch email, where applicable.
Delivery times are calculated from the date on which the order is dispatched.
Orders placed on a non-business day will be processed from the next business day.
Indicative delivery times and available delivery methods are provided on the “Delivery” page of the Website.
Delivery times are estimates and may be affected by circumstances beyond L’Atelier d’Amaya’s reasonable control. This does not affect the Customer’s statutory rights where an order is not delivered within the applicable legal timeframe.
11.2) Delivery to a Postal Address
L’Atelier d’Amaya delivers the Product(s) ordered to the delivery address provided by the Customer when placing the order.
The Customer is responsible for ensuring that the delivery address provided is complete and accurate. Any additional delivery or re-shipment costs resulting from an incorrect or incomplete address may be charged to the Customer.
Delivery charges are calculated based on the delivery method selected by the Customer at checkout and are displayed before the order is placed.
Products available on the Website may be delivered to the countries listed on the “Delivery” page, subject to stock availability and any applicable delivery restrictions.
Orders cannot be placed for delivery to addresses in countries that are not listed on the “Delivery” page.
ARTICLE 12: STATUTORY RIGHT OF WITHDRAWAL FOR DISTANCE SALES
For orders placed on the Website, the Customer has a statutory right to cancel their distance contract in accordance with applicable UK consumer protection legislation.
The Customer has fourteen (14) days from the day after receiving the Product(s) to exercise this statutory cancellation right, without having to provide a reason.
The Customer must notify L’Atelier d’Amaya of their decision to cancel within this fourteen (14)-day period by logging into their customer account, selecting the relevant order and following the cancellation or return process available on the Website.
The Customer may also exercise their statutory cancellation right by contacting customer service by email at contact@latelierdamaya.com or by using the cancellation form available in Annex 1 of these GTCS.
Once the Customer has notified L’Atelier d’Amaya of their decision to cancel, the Product(s) must be returned without undue delay and, in any event, within fourteen (14) days of the date on which the Customer notified L’Atelier d’Amaya of their cancellation.
Where the statutory cancellation right applies, L’Atelier d’Amaya will refund the Customer for the returned Product(s) and the standard delivery charge paid for the order. Additional delivery costs resulting from the Customer choosing a more expensive delivery method will not be refunded.
L’Atelier d’Amaya will cover the return shipping costs associated with the exercise of the statutory cancellation right.
The Customer must take reasonable care of the Product(s) while they are in their possession. The Customer may be liable for any reduction in the value of the Product(s) resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Product(s).
The refund will normally be made using the same payment method used for the original order and in the same currency as the original payment.
L’Atelier d’Amaya may withhold the refund until the returned Product(s) have been received or the Customer has provided evidence that they have been sent back, whichever occurs first.
Exceptions to the Statutory Cancellation Right
The statutory cancellation right does not apply to Products made to the Customer’s specifications or clearly personalised Products, including engraved or made-to-order Products, where an applicable legal exception applies.
Where a gift card is supplied as digital content immediately after purchase, the statutory cancellation right may be lost once supply of the digital content has begun, provided that the Customer has expressly consented to the immediate supply and acknowledged that they will lose their cancellation right.
These exceptions do not affect any statutory rights the Customer may have where a Product is faulty, damaged, misdescribed or otherwise does not comply with applicable consumer protection legislation.
Relationship with the 30-Day Commercial Returns Policy
The statutory cancellation right described in this Article applies for fourteen (14) days from the day after receipt of the Product(s).
In addition, L’Atelier d’Amaya offers a commercial returns policy allowing eligible Products to be returned for a refund or exchange within thirty (30) days from the date of receipt.
The conditions applicable to this thirty (30)-day commercial returns policy are set out in Article 13 “RETURNS AND EXCHANGES – COMMERCIAL RETURNS POLICY” and in the “Returns Policy” available on the Website.
The thirty (30)-day commercial returns policy is in addition to, and does not limit or replace, the Customer’s statutory rights.
ARTICLE 13: RETURNS POLICY AND COMMERCIAL CREDIT NOTES
In addition to the statutory cancellation rights described in Article 12 “STATUTORY CANCELLATION RIGHTS FOR DISTANCE SALES”, L’Atelier d’Amaya offers a commercial returns policy allowing eligible Products to be returned for a refund or exchange within thirty (30) days from the date of receipt.
This thirty (30)-day commercial returns policy applies in addition to the Customer’s statutory rights and does not limit or replace them.
After this thirty (30)-day period, no return or exchange request will be accepted under this commercial returns policy.
Personalised Products, including engraved or made-to-order Products, cannot be returned or exchanged under this commercial returns policy, except where the Customer is exercising applicable statutory rights in relation to a faulty, damaged, misdescribed or otherwise non-compliant Product.
For purchases made on the Website, the Customer must submit their return or exchange request through their customer account by selecting the relevant order and following the return process available on the Website.
The return or exchange request is subject to validation by L’Atelier d’Amaya.
If the request is refused, the Customer will be informed by email and may contact customer service at contact@latelierdamaya.com if they require further assistance.
If the request is accepted, the Customer will receive a confirmation email with the instructions required to return the Product(s).
Refunds
For a refund, the refund will be processed once the returned Product(s) have been received and checked by L’Atelier d’Amaya, in accordance with the applicable returns conditions.
The refund will normally be made using the same payment method used for the original order and in the same currency as the original payment.
Exchanges
For an exchange, L’Atelier d’Amaya will issue a credit note for the value of the returned Product(s) once the returned Product(s) have been received and checked.
The Customer may use this credit note to purchase another Product on the Website.
Credit notes issued as part of an exchange are valid for six (6) months from the date of issue and may be used in one or more transactions during this period.
If the value of the new Product is higher than the amount of the credit note, the Customer may pay the difference using an accepted payment method.
If the value of the new Product is lower than the amount of the credit note, the remaining balance may be used for a subsequent purchase during the validity period of the credit note.
Return Shipping Costs
L’Atelier d’Amaya covers the return shipping costs for eligible refunds and exchanges made under this commercial returns policy.
This commercial returns policy does not apply to Products that have been altered or made specifically to the Customer’s specifications, including engraving, personalisation or special requests, or to gift cards, except where applicable statutory rights provide otherwise.
ARTICLE 14: ONLINE RETURNS
The Customer must submit a return request in accordance with Articles 12 and 13 above.
Once the return request has been accepted, L’Atelier d’Amaya will provide the Customer with the instructions required to return the Product(s).
L’Atelier d’Amaya covers the return shipping costs for eligible returns made within the applicable statutory or commercial return period.
L’Atelier d’Amaya recommends returning the Product(s) using tracked postage. Where the Customer is provided with a prepaid return label, they should use the carrier and service specified in the return instructions.
If the Customer returns Product(s) using another carrier without prior agreement from L’Atelier d’Amaya, they may be responsible for the return shipping costs.
If the Customer wishes to return several Products from the same order, they should, where possible, return them together in the same parcel.
Returned Product(s) must be in an appropriate condition for return. The Customer may handle the Product(s) only to the extent necessary to establish their nature, characteristics and functioning. The Customer may be liable for any reduction in value resulting from handling beyond what is necessary.
Where a full refund is requested, the Customer must return all Products included in the order that are being returned, together with any promotional items or gifts that were provided on the condition of purchasing the relevant Products, where applicable.
If a return is incomplete, L’Atelier d’Amaya may be unable to process the full refund or may adjust the refund accordingly, where permitted by applicable law.
Engraved, personalised or made-to-order Products cannot be returned or exchanged under the commercial returns policy, except where the Customer is exercising applicable statutory rights in relation to a faulty, damaged, misdescribed or otherwise non-compliant Product.
Gift cards cannot be returned, refunded or exchanged under the commercial returns policy, except where applicable statutory rights provide otherwise.
If a return is required because of an error by L’Atelier d’Amaya, including where an incorrect Product or size has been sent or where a Product is faulty or does not comply with the order, L’Atelier d’Amaya will cover the reasonable return shipping costs and, where applicable, the cost of sending a replacement Product.
Where the Customer is entitled to a refund in such circumstances, L’Atelier d’Amaya will refund the relevant Product(s) and any applicable delivery charges in accordance with applicable consumer protection legislation.
ARTICLE 15: COMMERCIAL WARRANTY

ARTICLE 23: CUSTOMS DUTIES AND IMPORT TAXES
Orders delivered to the United Kingdom may be subject to customs duties, import taxes or other charges imposed by the relevant authorities.
Any customs duties, import taxes or other charges applicable to the order upon importation are the sole responsibility of the Customer and are not covered by L’Atelier d’Amaya.
L’Atelier d’Amaya does not determine or collect these charges and cannot guarantee the amount that may be payable. Customers are responsible for obtaining information about any applicable customs duties, import taxes or other charges from the relevant authorities before placing an order.
ARTICLE 24: “AMAYA & ME” LOYALTY PROGRAMME
The “Amaya & Me” loyalty programme (hereinafter the “Programme”) is developed by L’Atelier d’Amaya.
This Article sets out the content and operating procedures of the Programme applicable between L’Atelier d’Amaya and Customers who meet the eligibility requirements for enrolment (hereinafter the “Members”).
The Programme enables Members, under the conditions outlined below, to accumulate points when purchasing Products on the Website, and to benefit from loyalty rewards in the form of purchase vouchers.
24-1) Scope
The Programme is available on the Website.
The Programme does not apply to:
expenses related to “Services” (shipping fees, cord changes, after-sales service fees, complimentary piercing offered with the purchase of a prosthesis worth more than forty-nine (49) euros, etc.);
orders placed using a gift card;
orders placed using loyalty vouchers as defined below;
orders placed by L’Atelier d’Amaya employees;
orders paid using a credit note.
24-2) Conditions of Enrolment in the Programme
Enrolment in the Programme is automatic and free of charge, provided the Member creates a customer account on the Website or voluntarily provides their email address. Enrolment is personal and reserved for natural persons for their own personal use.
Enrolment in the Programme does not constitute prior acceptance to receive L’Atelier d’Amaya commercial communications (Newsletter and/or SMS).
However, reminders relating to the existence or expiry of loyalty vouchers will not be sent if the Customer has not subscribed to the Newsletter.
Enrolment results in the assignment of a personal loyalty number.
Each Customer may only be enrolled in the Programme once.
24-3) Accumulation of Points
The Programme enables each Member, after identification through their customer account on the Website, to accumulate points when purchasing Products on the Website according to the following scale: EUR 1 spent = 1 point.
Points become available within twenty-four to forty-eight (24–48) hours after purchase.
Each point is valid for twelve (12) months from the date of issue and cannot be carried over.
Points can never be exchanged for cash, have no monetary value, and are non-transferable.
24-4) Award of the Loyalty Reward
For every two hundred (200) points accumulated on the Member’s loyalty account, a loyalty reward called a “Loyalty Voucher” worth fifteen (15) euros will automatically be credited to the Member’s account.
All points held by the Member are visible under the “Loyalty Programme” section.
If the Member has not received a Loyalty Voucher, they may contact L’Atelier d’Amaya’s customer service.
The Member will be notified by email on the date the Loyalty Voucher is issued.
The Loyalty Voucher is personal and non-transferable.
24-5) Use of the Loyalty Voucher
The Loyalty Voucher cannot be converted into cash, a credit note or a gift card, and cannot be used to purchase a Product whose price is lower than the face value of the Voucher.
The Loyalty Voucher is indivisible; it cannot be used for several orders or multiple separate purchases.
Use of a Loyalty Voucher requires the Member to be logged into their loyalty account.
The Member may use up to five (5) Loyalty Vouchers in a single purchase on the Website, even if the vouchers have different expiry dates, provided they are all valid on the day of purchase.
Amounts paid using a Loyalty Voucher do not generate loyalty points, in accordance with Article 24-1 “Scope”.
The Loyalty Voucher is usable immediately upon issuance and is valid for six (6) months from the date it becomes available on the loyalty account. It must be used before the end of this period.
24-6) Cancellation of Points and Loyalty Vouchers
Points associated with an order that has been refunded or returned will be cancelled and deducted from the Member’s loyalty account.
If one or more Loyalty Vouchers were issued for such points, the Voucher(s) will also be cancelled.
24-7) Breach of Article 24 or Abusive Use of the Programme
Any breach of this Article and/or any abusive or fraudulent use of the Programme may result, at L’Atelier d’Amaya’s discretion, in the immediate suspension of the loyalty account, leading to the loss of all associated benefits. This may occur, for example, if L’Atelier d’Amaya determines that the same person holds multiple loyalty accounts.
L’Atelier d’Amaya reserves the right to take any action it deems appropriate in the event of abusive or fraudulent use of the Programme.
ARTICLE 25: COMPETITIONS AND PARTNER COMPETITIONS
L’Atelier d’Amaya may organise competitions in which prizes are provided by its commercial partners.
In this context, L’Atelier d’Amaya cannot be held liable for any damage arising from errors in prize allocation, for damage caused by the prizes to property, or for any lack of quality or conformity of the prizes.
Images of the prizes displayed in connection with the competition are for illustration only; they are not contractual and may differ from the prize actually awarded.
Prizes cannot be exchanged or refunded for any reason once awarded.
Winners must collect their prize within one month from the official notification of their win, which may be communicated via social media tagging.
After this period, the prize will be considered forfeited and the winners will no longer be entitled to claim it.
